State-of-the-art superyacht tender garages

In a previous article, we talked about winter storage and why it’s important . Today, we are going to see how to take storage to an extreme. Carrying tenders is a common feature of almost every luxury yacht, yet it’s the way in which these vessels transport them that sets the average yachts apart from the truly remarkable ones, which are able to effortlessly stow and deploy their tenders with unparalleled ease and sophistication. Take a look at some of the finest examples from around the world, starting with Nebula , the largest toy carrier with a helideck and a custom catamaran.

Nebula, a remarkable support vessel built by Astilleros Armón and Incat Crowther, boasts an impressive design that prioritizes accommodating toys, tenders, and crew. The tender garage, situated below the helideck, is a veritable marvel, featuring a 12.3-meter custom catamaran – endearingly referred to as the “shadow kitten” by designer Kirsten Schwalgien – as well as two RIBs and four Jet Skis, all effortlessly deployed via beam cranes boasting an impressive 11-tonne lifting capacity. To reduce the vessel’s height to three meters while hoisted on the deck, the top hydraulically lowers. Moreover, Nebula also boasts a full-size helicopter hangar, which can accommodate an Airbus H145 and provides cover for the tender garage below – the largest such hangar onboard any private vessel. Octopus is a world-renowned superyacht built for the ultimate exploration experience. It boasts an impressive fleet of watercraft that make it a marvel on the water. At the heart of the vessel lies the cavernous two-storey 36-metre internal wet dock. This is where the two main tenders are kept, ready to be launched through a giant transom door. The floodable dock is like having your own marina, with rows of smaller garages to store all the other water toys. These include a 9.3-metre custom Vikal limousine and two 8.7-metre custom Zodiacs, one for diving and the other for guests. Additionally, there are two 5.8-metre Zodiac Milpro MK-V available for watersports, as well as an impressive array of WaveRunners, jet skis, kayaks, surfboards, wakeboards, kitesurfers, windsurfers, and electric foil Fliteboards. To complete the fleet, Octopus features an 18-metre Delta 54, 13-metre Hinckley, and a new Triton 3300/6 submersible. With such an extensive range of watercraft, guests can enjoy almost any water-based activity they can think of, making it the ultimate exploration vessel.

The Wider 165, also known as Cecilia, was a major milestone for Wider, taking their innovative approach to yacht design to a new level. The float-in tender garage of Cecilia is a sight to behold, big enough to accommodate not only an eight-meter tender but also a three-person U-Boat Worx submarine. This impressive feature was a hit at the Monaco Yacht Show, where Cecilia made her debut. The Jules Verne-esque manipulator hand of the submarine, clutching a bottle of Bollinger, was a testament to the imagination and innovation that went into the design of this yacht. Launching the submersible is a breeze, thanks to the sophisticated crane installed overhead. But that’s not all that sets Cecilia apart from other yachts. When the tender bay is flooded, and both the tender and submarine are out, the area is transformed into a saltwater pool, providing a luxurious and refreshing way to cool off on a hot day. The aft end of the yacht is closed up, and the superstructure folds down on either side to create a vast sunbathing area on the long stern platform. The pool area is surrounded by comfortable sun loungers and shaded seating areas, perfect for relaxing and enjoying the view. The innovative design of Cecilia truly raises the bar for luxury yacht design and is a testament to the creativity and vision of Wider’s team.

Sanlorenzo’s Seven Sins, the first 52 Steel model, is a true masterpiece of modern yacht engineering and design. The vessel’s standout feature is undoubtedly the float-in tender garage that effortlessly transforms into a luxurious beach club. To achieve this engineering feat, Sanlorenzo’s team had to work with limited space, leading to meticulous planning, poring over plans and a plethora of engineering challenges that had to be overcome. The tender garage’s technical aspects were numerous, including the opening transom door, the docking tender garage, the up and down floor level, and the 12-tonne swimming pool that sits on top of a glass bottom. Not only is Seven Sins’ tender garage a technical marvel, but it also provides an elegant and spacious platform for water sports and activities. Once the water is pumped into the tender bay and the tender slips out, terraces open up to port and starboard, and a teak-soled section lowers from overhead, creating a large beach club. The club’s beauty is heightened by the light filtering down from the glass bottom of the pool above, creating a serene and tranquil atmosphere perfect for relaxation. The team of architects and engineers at Sanlorenzo had their work cut out for them, but their hard work paid off, resulting in a breathtaking yacht that boasts a unique and innovative tender garage/beach club feature. Seven Sins is a testament to Sanlorenzo’s commitment to excellence, engineering, and design. The vessel’s ability to effortlessly combine practicality, elegance, and luxury is a testament to the innovation that Sanlorenzo is known for.

Abeking & Rasmussen is a name synonymous with excellence in yacht building and they did not disappoint when it came to Aviva. The 98.4 metre vessel boasts an impressive interior designed by British design house RWD, which won the coveted Best Lifestyle Feature at the Boat International Design & Innovation Awards in 2018. However, it is not just the luxurious interior that makes Aviva stand out among the world’s superyachts. Aviva also houses a customised 14-metre Hunton XRS43 tender which is launched from a cradle in the garage via tracks over the bathing platform. This is not just any tender, but a true feat of engineering. Built to handle the toughest conditions, the tender can follow behind Aviva in challenging seas, and be lifted up as the yacht moves along. The launch and retrieval system is incredibly sophisticated, with hydraulic arms and sensors ensuring a smooth and safe launch every time. Beyond the Hunton XRS43, Aviva’s toy box is filled with all sorts of watercraft and watersports equipment, including two Sea-Doo personal watercraft, Seabobs, kayaks, stand-up paddleboards, and more. And for those who prefer to stay dry, there is a state-of-the-art cinema and an observation lounge with floor-to-ceiling windows that offer panoramic views of the surrounding seascape. Overall, Aviva is a masterpiece of yacht design, showcasing the perfect blend of luxury and adventure.

J’ade, the 58.2-metre CRN superyacht, is not only a sight to behold, but also an engineering marvel. With its transverse float-in tender dock designed specifically for an 8.24-metre Riva Iseo, J’ade is a testament to the innovative spirit of the CRN shipyard. The tender dock takes up almost the entire cross-section of the hull and contains around 5,000 gallons of water, making it the perfect spot to store and launch the Riva Iseo. Thanks to the engineers at CRN, the tender garage can be pumped out in less than three minutes, making it easy to access and launch the tender quickly and efficiently. To make this possible, the existing naval platform used for the shipyard’s 60-metre vessels had to be modified, and a study of the compartment’s effect on the ship’s trim had to be conducted to meet the classification requirements. Such attention to detail and commitment to excellence is what sets J’ade apart from other superyachts in its class. Not only is the tender garage practical and efficient, but it is also designed to protect the Riva Iseo from damage, with its very own tub. The underwater lights on the tender garage add a touch of dramatic effect to the whole experience. And let’s not forget the shell door on the port side that provides access to the tender garage from the water, making it even more convenient for launching and retrieving the tender. Overall, the transverse float-in tender dock on J’ade is an excellent example of how innovation and engineering can come together to create a seamless and luxurious experience for yacht owners and their guests.

Lady Fleur’s owners had a clear vision for their next build, one that would challenge the design team to create something truly exceptional. They wanted a yacht that was just 35 meters in length, but that would include a float-in tender garage and a swimming pool for their grandchildren. This was no easy feat, but the task ultimately fell to Bernd Weel Design and Holterman Shipyard, and it was on the first X-Treme Yachts X-105 model that this vision came to fruition. The engineering of the X-Treme Yachts X-105 is truly remarkable. This monohull can temporarily transform into a catamaran, at least for the aft third of the yacht. This is achieved by splitting the engine room into two watertight sections and building a compartment between them. When the tender is launched, the aft center section of the hull then lowers to allow the tender to float out or in. Once the tender is secured in the garage, the bay fills with seawater and rises to become a safe and secure 11-meter swimming pool that sits flush with the deck. The result is nothing short of remarkable. Lady Fleur’s unique features are both functional and visually stunning. When the yacht is at anchor, the swimming pool provides an incredible place for the owners and their grandchildren to relax and enjoy the water. When the tender is launched, the pool transforms back into a tender garage, and the yacht is once again ready to explore. These innovative features have not gone unnoticed. Demonstrations of the X-Treme Yachts X-105 at the Cannes Yachting Festival created traffic jams as curious onlookers stopped to marvel at the yacht’s unique capabilities. The features also earned Lady Fleur two gongs at the prestigious BOAT International Design & Innovation Awards in 2023, a testament to the ingenuity and creativity of the design team and shipyard.

Panam, the luxury yacht built by Baglietto, is equipped with state-of-the-art technology and innovative features that make it stand out in the market. One such feature is the garage that can accommodate a 5.5-meter tender, which is transversally fitted aft of the engine room. This smart design allows for maximum use of space without compromising on performance. The garage’s lower edge is placed below the waterline, ensuring that launching and retrieving the tender is a breeze. Baglietto has ensured that this operation is quick and efficient by designing the garage to fill with seawater before the shell door opens. The seawater immediately drains when the retrieving operation is complete, and the door is closed, ensuring that the tender remains safe and secure inside the garage. In addition to the efficient and safe tender handling, Panam boasts a winch and balancing cradle that ensures that the tender is towed inside with utmost precision. The innovative design allows the tender to enter the garage floating, making the embarkation process effortless and quick. This is particularly useful for guests who are eager to explore the waters and enjoy the yacht’s various amenities. The garage design is also partially floodable, which means that the tender can be stored in seawater, further increasing its protection and ensuring that it is in the best condition at all times. Overall, the transverse tender garage on Panam is an excellent example of how innovative design and engineering can enhance a yacht’s functionality and performance. With its smart design, quick and efficient tender handling, and partial floodability, the garage adds a new level of convenience and luxury to Panam, making it an ideal choice for those who want to explore the seas in style and comfort.

The future of superyacht tender garages is promising and exciting. With advancements in technology and design, superyacht owners and builders are exploring new ways to enhance the functionality and versatility of these spaces. One trend is the use of partially or fully floodable garages, which allow for easier and safer launching and retrieving of tenders. Another trend is the integration of multi-functional spaces, such as transforming tender garages into beach clubs or swimming pools. As superyachts continue to increase in size and complexity, the possibilities for innovative tender garage designs are endless.

Top Yacht Garages & Tenders

Float-in, floodable garages may sound like a fantasy but as mega-yacht technology evolves so does one of the most important parts of the yachting experience, the dinghy or tender. Every mother-ship needs a way to transport passengers to and from shore or the dock when the yacht is anchored or underway. Although some yachts are equipped with helicopters, tenders remain the golden standard for ferrying guests and owners to and from their mega-yachts. Many yachts have custom built tenders that match the lines or color scheme of their mother-ships.

What’s most unique is the way that mega-yachts store their tenders. Most large yachts carry a small fleet of tenders. All of them are stored in on-board “garages” or on chocks and launch through different methods. Many yachts utilize a davit system to retrieve tenders from their garages but in recent years certain builders have started incorporating float-in, flood-able garages to their designs.

The size of a yacht’s tender is only limited by the size of the mother-ship and the space the builder and owner wish to allocate for its storage. Paul Allen’s 414′ Lurssen mega-yacht, Octopus, is equipped with a submarine and 63′ express yacht. Kleven’s 351′ explorer mega-yacht “Ulysses” was launched in 2015 and has a custom 70′ expedition catamaran it uses as a tender. There are two custom davits in the fore-deck that were designed to bear the weight of this particular tender. For all the areas where the mother-ship can’t go the explorer tender will allow the owners and guests to spend extended time away exploring new areas. Pictured below is Microsoft co-founder Paul Allen’s super-yacht, Octopus. Built by Lurssen in 2003 it features a stern garage complete with a submarine and 63′ express yacht to take guests to areas where the mother-ship can’t go due to draft or other size constraints.

How Innovation Changed the Superyacht Garage Experience

The superyacht industry is one in which innovation thrives, where creative problem-solving sets new precedents and facilitates evolution in design. This is evident in the intriguing story behind the development of hydraulic systems in bespoke tenders, involving design legend Jon Bannenberg, Lurssen, and Vikal International.

With the proliferation of large yachts from the late nineties, designers began to expand the ‘beach club’ concept to create more outdoor space for owners enjoy their surroundings. This presented one practical challenge for yachts and their crew. The tender garage was and still often is seamlessly joined to the beach club, which can be problematic when storing large tenders in tight spaces, requiring the use of cradles built into the decks.

Not only can deploying and retracting tenders be a time-consuming process in such conditions, but there can also be risks involved for operational and crew safety, with crew in some cases needing to crawl on all fours to tie or untie the load from cradles.

In 2002, Australian custom tender manufacturer Vikal International, working with the ‘Godfather of Modern Yacht Design’, Jon Bannenberg, devised a simple, effective and cheap solution to the issue.

The idea was conceived during the build of 138m Lurssen superyacht Rising Sun, which Bannenberg had designed. While the yacht was in construction, Vikal developed a tender with an inbuilt hydraulic chock system to allow for better and more convenient use of the tender garage space.

Using hydraulic rams made in 316 stainless steel driven by an onboard DC hydraulic power pack, the legs could be deployed and retrieved in a matter of minutes. This would ensure that the garage space could be clear when the tender is out, and would reduce the operational complexity and risk for crew members.

Jon Bannenberg presented Vikal’s mock-up of the docking leg receptable to Larry Ellison, the owner of Rising Sun, who agreed to have the feature installed. Vikal and Bannenberg then began to work on the critical deck fitting mock-up.

Not long after, Jon was found to have a brain tumour and his decline thereafter was rapid. In the aftermath of Jon’s passing, the Lurssen order for the Vikal Limousine was cancelled. It would have been the first Vikal Limo to be fitted with the hydraulic system. 

The innovation of the hydraulic docking legs has since become a sought-after feature of Vikal’s larger bespoke tenders, and had been delivered for 14 superyachts including Anastasia, Nirvana, Barbara, Mayan Queen, Pelorus, and Ecstasea.

The application and efficacy of the hydraulic docking system remains very relevant to today. It is an easy choice to install for large tenders on superyachts, allowing the garage space to be utilised when the tenders are out and embracing crew safety.

The solution is a simpler and cheaper option than collapsible hydraulic cradles, which are built into the decks of some yachts. Removing the need for cradles, there is nothing to store away when the tender is out, and the deck space can be clear.

This even extends beyond its use in the garage, as thanks to the inbuilt cradling system, the tender is self-sufficient whether stored on-board or on dry land.

It is examples of innovative approaches to design such as this which ensure the experience on water is seamless both for owners and for crew. A dayboat is exactly what it sounds like—a vessel to spend the day on before retiring to somewhere else to spend the night. Traditionally it’s a European style of boating, relegated to boats in the 30- to 50-foot range. But in the last few years, thanks to a flood of new owners, the dayboat market has seen big design changes and enormous growth—literally. The boats keep getting larger to the point where many should be rightfully be called day yachts . The trend started with the HCB Custom 65 . The boat, Estrella , was a monster center-console design, powered by six outboards totaling more than 3000 hp. That 2018 launch set a new standard for dayboats.

But the new generation of maxi-sized dayboats aren’t limited to utilitarian center consoles. The 77-foot Wajer that former quarterback Tom Brady purchased last year is a good example of a more yacht-like design, while the 115-ft. Vanquish Veloce VQ115 is an even more dramatic case.

These new designs, all with large staterooms, show how much the definition of dayboat has changed from smaller open boats. The intent of the design is now as important as the form—to maximize exterior space, and with it, the number of guests who can come on board to enjoy a day on the water. There are the usual salons, galleys and heads, but the focus is the exterior, or in most cases, the blending of the interior and exterior through large glass doors that slide and conceal to connect inside and out.

Here are seven of the largest, newest dayboats on the water today.

Vanquish VQ115 Veloce

Vanquish’s VQ115 Veloce is the largest dayboat on this list. The 115 has an aluminum hull, and with triple 2,650-horsepower MTU Rolls-Royce V16s matched to surface drives, Vanquish says it can hit speeds of 50 mph. The VQ115 has two separate tender garages: one for a VQ16 and the other a VQ11, both bearing a resemblance to the mothership. A Jacuzzi on the boat’s foredeck is sure to be a popular at anchor, while the aft cockpit connects to an open-arrangement salon via sliding glass doors. That arrangement puts the day in day yacht. A boat this size will be able to accommodate four crew members.

Scout 670 LX

Currently under build in South Carolina, the Scout 670 LX will be the largest center console ever built when it debuts at the 2024 Miami International Boat Show. With five 600-horsepower Mercury outboards, this Scout should see top speeds close to 60 mph. Three different versions of this boat will be made available, including an LXF (luxury fish), LXC (luxury cruiser), and LXS (luxury sport). The boat was designed in conjunction with superyacht design studio Harrison Eidsgaard. It will be constructed in carbon-fiber epoxy. The forepeak master will have its own en suite—a design breakthrough for vessels of this type.

When you’re the greatest quarterback of all time, and also find yourself back on the singles scene in your early 40s, what better way to re-acclimate yourself than a hot boat? And that’s exactly what Tom Brady bought for himself. The Wajer 77 is a Dutch-built dayboat with one of the most beautiful sterns in yachting. It has a 40-mph top speed and cruising range of over 400 miles. Wajer’s trademark walkaround design opens up the alfresco entertainment options onboard, meaning the boat can ferry large numbers of guests comfortably to the sandbar and back. The boat also has three staterooms, plus crew accommodations for two, as you might expect from a dayboat this large.

With an axe bow and a reverse-rake windshield, mirrored by a reverse-rake windscreen on its flybridge, the Pardo Endurance 60 conjures up the profile of a stylish workboat. But it is built for play. Its walkaround design couples with foldout terraces in the cockpit to open up the deck space for entertaining. A hydraulic swim platform aft holds a tender for easier beach access, or it can double as a beach club. The Pardo has twin 600-horspower Volvo Penta D8s matched to IPS drives, making it easy to dock and maneuver at slow speeds. The boat runs the low-to-mid-20-mph range.

Bluegame 75

Unveiled last year at the Cannes Yachting Festival, the Bluegame 75 is the first edition in a line of multihulls the Italian builder plans to release. Bluegame is known for its innovative designs, and this boat was penned in conjunction with Bernardo Zuccon and Piero Lissoni with a hullform that mimics an America’s Cup chase boat. The 75 will also be able to carry up to 56 solar panels to minimize its carbon footprint. The interior layout is intended to maximize the boat’s natural beaminess. Open arrangements the norm particularly on the lower deck, where an unorthodox salon lies at sea level, and the upper deck is fully open for social events.

Zeelander 7

The 66-foot Zeelander 7 is this Dutch yard’s new flagship. Zeelanders all have similar lines as well as high levels of fit and finish. The boat has a foldout beach club from its transom, with a generous amount of tumblehome. A four-stool bar at the bulwark separating the cockpit and salon complements a dining settee in the aft section of the cockpit. The boat’s fully enclosed salon has nearly 360-degree worth of windows. This boat can reach 40 mph at top end.

From Brazil comes the Okean 80, a boat clearly built for a party. Like its smaller sisters, the builder’s flagship has foldout terraces to port and starboard on its main deck. Also on the main deck is a pane of smart glass between the helm and salon that can become see-through or opaque at the touch of a button. Up top, the 80’s flybridge features a wetbar and modular furniture. A beach club at the hydraulic swim platform is partially recessed into the transom for shade, a design trait which adds a sense of gravitas to the space.

Saisi par la justice italienne en mars 2022, ce mastodonte appartiendrait au président russe en personne. Reportage.

Discrètement, elle a encore grandi. Depuis son arrivée au port, la princesse « Scheherazade » a pris 5 mètres de plus. « Ça a duré un an », raconte Guido*. Comme tous les membres du club nautique, cet entrepreneur à la retraite était aux premières loges pendant les travaux. « Mais on n’a rien vu, ils ont tiré des bâches. On ne savait pas ce qu’ils fabriquaient ! » Ce n’est que des mois plus tard que les habitants de Marina di ­Carrara ont compris que le « bateau de Poutine » s’était fait rallonger la poupe. Alors tout le monde y est allé de son commentaire. « A-t-il fait ça pour sortir grandi de la guerre ? » Guido a sa théorie : « Il voulait que le pont soit plus pratique pour la baignade. »

Des robinets en or, plusieurs piscines dont une en cristal, et même un bloc opératoire à bord… Saisi, le «Dilbar », palais flottant d’Alicher Ousmanov, qui a fait fortune dans l’industrie minière, n’a pas bougé du port de Hambourg depuis mars 2022.

Dressé au milieu des pontons, le club nautique de Marina di Carrara serait un endroit charmant sans son décor industriel. À droite, les bureaux géants d’Italian Sea Group, l’armateur star de la péninsule qui offre à ses employés un spa, un restaurant branché et organise un défilé de mode pour sa collection de yachts Giorgio Armani. En face, une longue jetée gâche la vue, alignant des conteneurs ; une pelleteuse soulève des morceaux de marbre brut arrachés aux montagnes de Carrare qui, derrière nous, découpent un ciel gris et menaçant. À 86 ans, Guido n’a plus l’énergie de naviguer, mais avance d’un pas alerte sur les pontons. Il s’arrête devant un petit yacht défraîchi. « C’étaient des Russes. Ils offraient le champagne à tout le monde. Du jour au lendemain, ils ont disparu. » Leur bateau a-t-il été saisi, gelé, confisqué ? Il existe toute une palette de désignations juridiques. Guido n’a pas la réponse. Il montre l’espace où était collée la pancarte de la Guardia di finanza : disparue elle aussi. Le rafiot gisant au milieu des algues fait pâle figure comparé au scintillant « Ebony Shine ». Le superyacht de 76 mètres attend sa séance d’entretien sur le quai d’Italian Sea Group.

Son propriétaire, « ­Teodorin » Obiang, est le vice-président de la Guinée équatoriale, fils de ­Teodoro Obiang, président depuis 1979. Derrière cet emblème de toute-­puissance estimé à 100 millions d’euros s’en profile un autre sept fois plus cher et presque deux fois plus grand : le « ­Scheherazade ». Ses six étages montés sur une coque en acier recouverte d’aluminium peuvent accueillir 97 moussaillons pour cocooner jusqu’à 40 passagers. Sur le toit : une forêt d’antennes radar, de cheminées et de radômes, ces boules blanches qui protègent les équipements électroniques.

Le monstre de 140 mètres est estimé à 700 millions de dollars : le prix d’une frégate. Lorsqu’il est arrivé au port, son attirail technologique a beaucoup intrigué. « On aurait dit un navire de guerre, se rappelle un vendeur d’articles nautiques. Quand il était en mer, des Zodiac tournaient autour avec un gyrophare, et des gaillards restaient accoudés toute la journée pour éloigner les curieux. À chaque manœuvre, il y avait des flics italiens à terre et des agents de sécurité privée. » À l’exception du commandant britannique, l’équipage ne sortait pas, ou presque. Peu après le déclenchement de la guerre en Ukraine, la fondation de l’opposant Alexeï Navalny – mort dans sa prison en février dernier – a publié la liste de l’équipage, pour moitié constitué d’agents du FSO, le service de sécurité de Vladimir Poutine. Puis le navire a été saisi en mai. « Le lendemain, ils sont tous partis et on a vu débarquer un équipage 100 % british ! » s’amuse notre commerçant.

L'immobilisation du « ­Scheherazade » n’a pas affecté l’économie locale

Deux ans et demi plus tard, l’affaire du « bateau de ­Poutine » n’amuse plus grand monde. Dans les discussions de comptoir revient une complainte sur le thème de « l’ingérence américaine » et du « c’était mieux avant », en souvenir du bon vieux temps où les oligarques copinaient avec Berlusconi – grand ami de Poutine – et s’achetaient yachts et villas à tire-­larigot. Pourtant, l’immobilisation du « ­Scheherazade » n’a pas affecté l’économie locale. L’Italian Sea Group affiche une croissance annuelle à deux chiffres et son carnet de commandes se rapproche des 2 milliards d’euros. Difficile aussi d’estimer le coût pour les comptes publics. Si l’État paie le parking de cet encombrant VIP, la législation européenne lui épargne les frais d’entretien qui, comme pour tous les yachts, s’élèvent chaque année à plus de 8 % de sa valeur – soit presque 60 millions d’euros !

« Lorsqu’un bien est visé par une mesure de gel, explique Me Olivier Attias, avocat spécialiste dans les sanctions internationales chez August Debouzy, son entretien reste à la charge du propriétaire. Si une infraction est suspectée, le bien peut être saisi dans le cadre d’une enquête pénale, mais le propriétaire doit toujours en assurer l’entretien s’il n’en est pas dépossédé. Cette obligation ne cesse que si le bien est confisqué, uniquement sur une décision judiciaire. » La même règle vaut pour les dizaines de yachts immobilisés en Europe. Libres aux pays concernés de demander aux propriétaires d’en payer l’entretien. Mais encore faut-il les retrouver ! Sur le papier, le « Scheherazade » n’appartient pas à Poutine. La déclaration de patrimoine du président russe publiée avant les élections de mars dernier ne mentionne qu’un appartement de trois pièces à Saint-Pétersbourg et un garage trop petit pour ranger trois vieilles voitures – deux Gaz et une Lada – et une caravane ! Selon les documents officiels, le « Scheherazade » est détenu par une société offshore au nom de l’oligarque Edouard Khudainatov. Cet ancien éleveur de cochons enrichi dans le pétrole servirait de prête-nom, selon le FBI, qui a constitué une équipe spécifique. Mais comment pourrait-il sortir des fonds, puisqu’il serait lui-même sous sanction ? « Il existe des licences », poursuit Me Attias.

Il est estimé à 700 millions de dollars

Le ministère des Finances nous confirme que « la direction générale du Trésor délivre des dérogations afin d’assurer le maintien en l’état de la ressource économique gelée ». Les services de Bercy refusent toutefois de commenter « les cas particuliers ». Pourtant, les yachts gelés dans l’Hexagone ne sont a priori pas nombreux et les plus gros difficiles à cacher. Le plus connu est l’« Amore Vero ». Estimé à 120 millions d’euros – le prix d’un Rafale, options incluses –, le navire de 86 mètres a été saisi le 1er mars 2022. Son système d’identification automatique – le GPS marin connu par son acronyme anglais AIS – le place depuis sur un quai de La Ciotat. Les touristes peuvent admirer sa silhouette élancée et sa coque luisante, magnifiquement entretenue, semble-t-il, par son propriétaire supposé : Igor Setchine. Le président du groupe pétrolier Rosneft et très proche conseiller de Vladimir Poutine dément en être le détenteur, mais selon les services des douanes, il en serait le bénéficiaire économique. La saisie du bateau a été confirmée par le Conseil d’État en janvier dernier, mais aucune procédure judiciaire connue n’a depuis abouti à une confiscation. « C’est à double tranchant, nous confie l’avocat d’un oligarque, car à partir du moment où la justice prononce une confiscation, l’État doit payer les frais d’entretien, le port d’attache, l’équipage. En général, le bien est mis en vente rapidement, mais encore faut-il trouver un acheteur ! »

Car les clients sont rares. L’histoire la plus cocasse est celle de l’« Alfa Nero », un yacht de 82 mètres gelé et immobilisé à ­Antigua-et-Barbuda. Les autorités de cette petite île indépendante, située au nord de la ­Guadeloupe, se sont vite trouvées à court de moyens pour soigner ce palace flottant, estimé à 100 millions de dollars. La suite a été racontée par le « Wall Street Journal ». Après avoir vidé les dernières boîtes de caviar et sifflé les grands crus du propriétaire, l’équipage se plaint de manquer de vivres et menace de s’en aller. Le bateau n’étant plus couvert par les assurances, il est saisi et mis en vente. L’ancien patron de Google Eric Schmidt se porte acquéreur avec une offre à 67 millions de dollars. Les autorités d’Antigua-et-Barbuda se réjouissent, mais le propriétaire russe, le roi du phosphate Andreï Guriev, s’en mêle.

«On aurait dit un navire de guerre», se souvient un riverain

Ses avocats multiplient les recours et le port de Saint John’s bruisse des rumeurs les plus folles : un sous-marin russe serait tanqué au large, prêt à torpiller le nouveau proprio. Eric Schmidt renonce. Le mois dernier, les autorités ont finalement annoncé la vente de l’« Alfa Nero » à un anonyme, pour seulement 40 millions de dollars. Au moins, les voilà tirés d’affaire ! Les ­Américains n’ont pas eu cette chance. Encombré par un gigayacht saisi aux îles Fidji, le département de la Justice a lancé des procédures dès octobre 2023 pour le vendre. Mais, en juin dernier, un tribunal de Manhattan a débouté la requête. D’autres pays empoisonnés par ces patates chaudes cherchent à s’en défaire. Le Monténégro vient de mettre en vente le « Luminosity », 106 mètres, qui peut aujourd’hui se visiter sur le quai de Tivat. Encore faut-il être prêt à lâcher 135 millions de dollars ! Et ne pas craindre les éventuelles représailles du propriétaire : il s’agirait du même Andreï Guriev.

Des mâts rotatifs de 90 mètres de haut… «A», le plus grand voilier du monde, pensé par Philippe Starck, appartient à l’industriel Andreï Melnitchenko. Dans le port de Trieste, le 10 mars 2022.

Pour toutes ces raisons, les pays concernés par les gels préfèrent agir de la façon la plus discrète possible. Le mieux étant de faire oublier ces bateaux fantômes. Cela explique sans doute le curieux destin d’un bateau disparu des écrans radar depuis mars 2022 : le « Rahil », traduction arabe de Rachel, ce prénom biblique qui évoque le voyage. Son propriétaire n’est pas un émir, mais l’oligarque Arkadi Rotenberg. Un ancien champion de judo qui a connu le président russe sur les tatamis. Il dirige à présent un empire industriel qui produit, entre autres, des tubes pour lance-roquettes et des munitions. Début 2022, Fausto Biagetti, un artisan doreur italien très prisé par les fortunes du Moyen-Orient, s’apprêtait à décoller pour la Côte d’Azur pour décorer les boiseries du « Rahil », quand la commande est tombée à l’eau avec l’invasion de l’Ukraine. « Après deux années de Covid, c’était dur ! » Heureusement pour lui, Fausto a pu se rattraper : missionné par une mystérieuse société monégasque, il a été envoyé sur le chantier du « Scheherazade »… sous la bâche !

Estimé à 75 millions de dollars, le « Rahil » a d’abord été immobilisé dans le bassin de radoub à Marseille, puis ses transbordeurs ont été coupés. En mai dernier, le média en ligne « Blast » révèle sa position sur une digue éloignée du port de Marseille, à l’abri des regards. Contactées par nos soins, les autorités portuaires semblent pourtant incapables de le localiser et nous renvoient vers le bassin de Radoub. « Ça fait longtemps qu’il n’y est plus ! » dit en riant Hakim, le patron du bistrot de l’Océan, à l’entrée du bassin. S’il est plus facile pour un chameau de passer par le trou d’une aiguille que pour un yacht de 48 mètres de passer inaperçu, les autorités françaises y sont parvenues ! Ni les douanes, ni la direction du Trésor, ni le ministère des Finances n’acceptent de nous en dire davantage.

Le dernier cas connu en France concerne l’homme d’affaires Alexeï Kouzmitchev. Ses deux bateaux d’une vingtaine de mètres chacun ont été saisis en mars 2022. Plus chanceux que les autres, ce Russe vivant à Paris a obtenu de son avocat Me Philippe Blanchetier l’annulation de la procédure des douanes. Ses deux biens ne sont donc plus saisis… mais toujours gelés. Il faut être juriste pour saisir la nuance. « Le risque de la saisie, explique Me Thierry Bontinck, c’est que le bien saisi peut être liquidé et vendu. » Cet autre avocat spécialiste des régimes des mesures restrictives défend une dizaine de personnalités visées par des sanctions. Tous ont bien conscience du risque de confiscation. « Ce qui les inquiète, c’est la volonté affichée du haut représentant de l’Union européenne de faire saisir et confisquer un maximum de biens pour financer la guerre en Ukraine. »

Russia superyacht symbolises challenge of seizing assets

A legal battle over who owns a luxury superyacht symbolises the difficulties of seizing Russian assets since the war in Ukraine started.

When BBC reporters investigated the case of the £54m Alfa Nero, it led them to a British firm whose lawful help allows a Russian oligarch to claim that such mega-assets do not really belong to him at all.

This week a court case resumes in Antigua. It was launched by the daughter of Russian billionaire Andrey Guryev to challenge the seizure of the Alfa Nero superyacht.

The island's government wants to sell the vessel and keep the proceeds. It even changed the law ahead of auctioning the yacht off last June.

It was eventually purchased by former Google CEO Eric Schmidt for £54m, but he has now withdrawn his bid amid a flurry of legal challenges, including the one from Mr Guryev's daughter.

She claims she is the sole adult beneficiary of the trust that owns the yacht, rather than her billionaire father.

Investigating that challenge led the BBC to uncover some £500m worth of assets connected to the sanctioned billionaire.

It also helped reveal how trust structures lawfully managed by a British firm over many years allow Mr Guryev to claim, by the time he was sanctioned, that the yachts and London properties we have identified do not belong to him at all.

The Kremlin connection

On a tour in Antigua's exclusive Falmouth Harbour, a port employee is open to talking about the Alfa Nero's many features, but when we ask who used to own it, his tone changes.

"I don't know," he says, as he looks down at the gleaming, teak deck.

Before the yacht was seized in April, the US government said it belonged to Mr Guryev, whom it called a "known close associate" of Vladimir Putin.

The US Treasury says Mr Guryev is part of a group of "Kremlin-connected elites" who "generate substantial revenue for the Russian regime".

Mr Guryev earned his wealth from PhosAgro, a fertiliser company he co-founded following the collapse of the Soviet Union.

By the time PhosAgro listed on the London Stock Exchange in 2011, Mr Guryev had bought Witanhurst Estate, a dilapidated Georgian mansion he transformed into one of London's most expensive properties, estimated to be worth £300m.

Companies House filings submitted in May 2023 show Witanhurst Estate, along with the Alfa Nero, is actually connected to the Guryev family through an address in Guernsey, a British crown dependency.

And they are not the only incredibly valuable assets linked to this same address in the Channel Islands.

The Luminosity is one of the world's biggest hybrid superyachts, measuring in at 353ft (107.5m). It has its own helipad plus a separate swimming pool and jacuzzi, along with dozens of staff.

Shortly after Russia's invasion of Ukraine began, the Luminosity left port in northern Italy, arriving in non-EU Montenegro on 10 March.

That was the day after Mr Guryev's son was sanctioned by the EU.

When a government inspector boarded, they discovered that this huge vessel was also linked to the same address in Guernsey.

'Not our client'

When you travel to that address, you find the unassuming offices of a wealth manager called Opus Private.

On its website, the firm said it helped "some of the world's wealthiest individuals manage and protect their assets".

Along with a number of other properties, including a £50m London penthouse, we established a total Guryev family portfolio worth over £500m, all linked to this one firm.

We have also seen documents showing the relationship has been going on for at least a decade.

Back in Antigua, that relationship with at least some members of the Guryev family continues.

Court documents we have seen show Opus Private was involved in a legal action that failed to stop the Alfa Nero initially being auctioned off.

It is important to note that it is legal to keep working for a sanctioned individual, with government permission, and Mr Guryev's daughter has not been sanctioned by the UK, EU or US.

The court documents detail how ownership of the superyacht is tied up in a trust, which a judge in Antigua suggested Mr Guryev still exercised a degree of control over.

We know there has been a change in the beneficiaries of the trust, but we cannot independently determine when it happened. If it was after sanctions were imposed, it would be unlawful; if it was before, it would not.

Both Mr Guryev's daughter and Opus told us it happened before her father was sanctioned.

Opus also insisted that Mr Guryev was not their client as he was no longer a beneficiary of the trust.

But the firm says it has made UK and Guernsey authorities aware of the trust assets it treats as frozen in line with UK sanctions against Mr Guryev. It says it treats these assets as frozen because, while Mr Guryev is not a beneficiary of the trust, he is deemed to have "control" over it under UK sanctions law.

A very different approach in Ukraine

These assets are being watched closely in Ukraine, where the cost of war damage is estimated at more than £300bn, and rising.

"We've been quite intensively confiscating assets belonging to Russian individuals," says Vlad Vlasiuk, a sanctions adviser to Ukraine's president Volodymyr Zelensky.

Not only has Ukraine sanctioned around 9,000 people and companies, it has gone further than most of its allies in moving from freezing to seizing assets. Among those sanctioned by Ukraine are Mr Guryev, his son, wife and daughter.

"We think that Mr Putin is weaponising the fertiliser [industry] and threatening the whole of the world in terms of global food security. We don't want that to happen," Mr Vlasiuk says.

Since the sanctions were imposed, Guryev Snr and Jnr have both resigned their positions at PhosAgro, but the family remains major shareholders.

The company - which operates globally - has made record sales since the invasion, and Guryev Jnr even met President Putin in April to discuss the fertiliser industry.

Mr Vlasyiuk would like to see the UK go further when it comes to frozen assets linked to Mr Guryev: "I think those assets should be confiscated and then transferred to Ukraine."

They include the Witanhurst Estate and a five-storey penthouse with views across the River Thames, estimated to be worth £50m.

"Those monies would be very much used to rebuild Ukraine and that would also send a strong message," he says.

The UK government's position is to hold on to frozen assets until Russia pays compensation for the war damage it has caused in Ukraine.

The two departments responsible for sanctions, the Treasury and the Foreign, Commonwealth and Development Office, did not respond to specific questions about the Guryev family's UK-based assets.

A spokesman for Mr Guryev said there was no "proper or legitimate basis" for the sanctions against him.

Opus Private told us: "Trusts are legal structures, and their use is lawful. Opus provides trust services to, and for the benefit of, the discretionary beneficiaries of the trust structure."

"It provides those trust services in compliance with all applicable laws," it said.
